These Terms & Conditions ("Terms") govern your access to and use of the Aman mobile application, the Aman website at www.myamanapp.com, and any related services, features, and content (together, the "Platform" or "Service"), operated by Aman ("Aman", "we", "us", or "our"). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms.
1.1 By downloading, installing, accessing, browsing, registering for, or otherwise using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any documents expressly incorporated by reference (including our Privacy Policy). If you do not agree to these Terms, you must not access or use the Platform.
1.2 If you are using the Platform on behalf of an organization or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" include that entity.
1.3 Your continued use of the Platform after any modification of these Terms constitutes your acceptance of the modified Terms, as further described in Section 23 (Changes to Terms).
1.4 These Terms apply to all users of the Platform, including individuals seeking mental-health or therapy services ("Patients"), independent practitioners offering such services ("Therapists" or "Providers"), and casual visitors.
2.1 The Platform is intended for use by individuals who are at least eighteen (18) years of age. By using the Platform, you represent and warrant that you are at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and that you have the legal capacity to enter into a binding agreement.
2.2 Minors. The Platform is not directed to, and may not be used by, individuals under the age of 18 except where a parent or legal guardian (a) is themselves an eligible adult user, (b) has provided verifiable consent in a manner acceptable to Aman and required by applicable law, and (c) agrees to be bound by these Terms on behalf of and together with the minor and to supervise the minor's use of the Platform. Where such verifiable guardian consent has not been obtained, minors must not use the Platform.
2.3 We reserve the right, to the maximum extent permitted by applicable law, to request proof of age, identity, or guardian consent at any time, and to suspend or terminate any account for which such proof is not satisfactorily provided.
2.4 You further represent that you are not barred from receiving the Service under the laws of your country of residence or any other applicable jurisdiction, and that you are not located in, or a resident of, any territory in which use of the Platform would be unlawful.
For the purposes of these Terms, the following definitions apply:
3.1 "Aman", "we", "us", "our" means Aman and, where the context requires, its affiliates, officers, directors, employees, agents, contractors, licensors, and successors.
3.2 "Platform" / "Service" means the Aman mobile application, the Aman website, and all associated software, content, features, and functionality.
3.3 "Patient" (also referred to as a "Client"; the terms are used interchangeably) means a user who accesses the Platform to discover, browse, contact, book, or engage independent Therapists for mental-health, counselling, or therapy-related services.
3.4 "Therapist" / "Provider" means an independent practitioner who creates a listing or profile on the Platform to offer mental-health, counselling, or therapy-related services to Patients.
3.5 "User", "you", "your" means any person who accesses or uses the Platform, including Patients, Therapists, and visitors.
3.6 "Content" means any text, images, profiles, certificates, credentials, messages, reviews, ratings, audio, video, or other materials uploaded, submitted, posted, transmitted, displayed, or otherwise made available through the Platform.
3.7 "Therapy Services" means the mental-health, counselling, psychological, therapeutic, or related services that a Therapist may provide to a Patient. Therapy Services are provided solely by the Therapist and not by Aman.
3.8 "Verified Therapist" badge means a visual indicator that Aman may, in its sole discretion, display in connection with certain Therapist listings, as described in Section 6.
4.1 Aman is a technology platform only. Aman provides an online matching and discovery platform that enables Patients to search for, discover, view information about, contact, and arrange to engage independent Therapists. Aman's role is limited to facilitating connections and providing the supporting technology, scheduling, and (where applicable) payment-processing tools.
4.2 Aman is not a healthcare provider. Aman does not provide, and is not in the business of providing, medical, psychological, psychiatric, counselling, therapeutic, diagnostic, treatment, or any other healthcare services. Aman is not a medical practice, clinic, hospital, healthcare facility, or referral service, and nothing on the Platform should be interpreted as such.
4.3 No therapeutic or doctor–patient relationship with Aman. No physician–patient, therapist–client, fiduciary, or other professional or care relationship is created between you and Aman by your use of the Platform. Any such relationship, if formed, exists solely between the Patient and the independent Therapist.
4.4 Therapists are independent. All Therapists listed on the Platform are independent practitioners. They are not employees, partners, agents, representatives, or contractors of Aman, and Aman does not employ, supervise, direct, or control any Therapist or the manner, methods, timing, or substance of any Therapy Services. Aman does not assign, allocate, or refer specific Patients to specific Therapists.
4.5 No responsibility for Therapy Services. To the maximum extent permitted by applicable law, Aman is not responsible or liable for the acts, omissions, advice, conduct, competence, qualifications, diagnoses, treatment, recommendations, statements, or outcomes of any Therapist or for any Therapy Services obtained through the Platform. Decisions about whether to engage a Therapist, and reliance on any Therapy Services, are made by the Patient at the Patient's own discretion and risk (see Section 17, Assumption of Risk).
4.6 Aman may modify, suspend, or discontinue any part of the Platform at any time, with or without notice, to the maximum extent permitted by applicable law.
5.1 Independent selection. Patients independently select their own Therapist. Aman does not choose a Therapist for any Patient and does not operate any clinical "matching engine" that assesses suitability of a particular Therapist for a particular Patient's condition.
5.2 No endorsement. Aman does not recommend, endorse, vouch for, rank by quality, refer, or promote any Therapist. The inclusion of a Therapist on the Platform is not an endorsement, certification, or guarantee of that Therapist by Aman.
5.3 Listing order is not an endorsement. The order, ranking, prominence, sequence, or manner in which Therapists or search results are displayed (which may be affected by factors such as search relevance, availability, location, filters you apply, Patient preferences, or other operational considerations) does not constitute a recommendation, endorsement, or representation by Aman as to the quality, suitability, or fitness of any Therapist.
5.4 Your due diligence. You are solely responsible for evaluating, selecting, and verifying the suitability of any Therapist, including by reviewing their stated credentials, asking questions, and exercising your own independent judgment before and during any engagement.
6.1 Pre-activation credential review. Every Therapist is required to submit their professional licence(s), registration(s), certificate(s), or equivalent credentials during onboarding. A Therapist account is not activated, made visible to Patients, or able to receive bookings until Aman's operations team has reviewed the submitted documents and approved the account. Aman may verify the authenticity or status of a submitted credential with the issuing authority or other appropriate sources, may request additional information or documents at any time, and may suspend or deactivate a Therapist account where a credential appears to have lapsed, been suspended, or been revoked, or where other concerns arise.
6.2 Scope of review. Aman's review is an administrative, document-based review; it is not a clinical evaluation and not a guarantee of quality, competence, or outcomes. Except as expressly required by applicable law, Aman does not undertake to (a) conduct background checks or criminal-record checks; (b) continuously monitor the ongoing validity, currency, or status of any licence, registration, certificate, or credential after approval; or (c) supervise the provision of any Therapy Services.
6.3 No warranty as to Therapists. To the maximum extent permitted by applicable law, Aman makes no representation or warranty, express or implied, regarding any Therapist's qualifications, identity, licensure, experience, competence, character, fitness, insurance, or suitability, or regarding the accuracy or completeness of any information a Therapist provides.
6.4 "Verified Therapist" badge. Aman may, in its sole discretion, display a "Verified Therapist" badge (or similar indicator) in connection with certain Therapist listings. The badge signifies only that the Therapist has met Aman's then-current verification criteria for that badge.
6.5 What the badge does not mean. The "Verified Therapist" badge is not an endorsement, recommendation, referral, ranking, or guarantee of quality, competence, or outcomes, and does not imply that a badged Therapist is superior, more qualified, more suitable, or safer than any Therapist who does not display the badge. Consistent with Section 5, the presence or absence of the badge does not constitute a recommendation or endorsement by Aman, and Patients remain solely responsible for selecting their own Therapist. Aman may add, change, suspend, or remove the badge or its criteria at any time, to the maximum extent permitted by applicable law.
7.1 THE PLATFORM IS NOT FOR EMERGENCIES OR CRISES. Aman and the Platform are not designed for, and must not be used in, medical emergencies, psychiatric emergencies, or crisis situations. The Platform does not provide emergency, urgent, or crisis services and cannot dispatch emergency responders.
7.2 IF YOU OR ANY OTHER PERSON IS IN DANGER, EXPERIENCING A MEDICAL OR MENTAL-HEALTH EMERGENCY, HAVING THOUGHTS OF SELF-HARM OR SUICIDE, OR AT RISK OF HARMING YOURSELF OR OTHERS, DO NOT USE THE PLATFORM. Instead, immediately call your local emergency services number (for example, 911, 112, 999, or the equivalent in your country), contact a local crisis or suicide-prevention hotline, or go to the nearest emergency room or hospital.
7.3 Communications sent through the Platform may not be read or responded to immediately and are not monitored for emergencies. Reliance on the Platform in an emergency may result in delay of, or failure to obtain, necessary care, for which, to the maximum extent permitted by applicable law, Aman is not responsible.
8.1 The Platform, and any content made available by Aman itself (as distinct from content provided by Therapists or other users), is provided for general informational and facilitation purposes only and does not constitute medical, psychological, psychiatric, legal, financial, or other professional advice.
8.2 Nothing on the Platform is intended to be, or should be used as, a substitute for professional diagnosis, advice, or treatment from a qualified healthcare provider. You should always seek the advice of a qualified professional with any questions regarding a medical or mental-health condition, and never disregard or delay seeking professional advice because of anything accessed through the Platform.
8.3 Any advice, opinion, or information provided by a Therapist is the sole responsibility of that Therapist and does not represent the views of Aman.
9.1 Registration. To access certain features, you must create an account and provide accurate, current, and complete information, and keep that information up to date. Accounts may be created using supported sign-in methods (which may include third-party authentication providers); your use of such methods is subject to the applicable third-party terms.
9.2 Account security. You are responsible for safeguarding your account credentials and for all activity that occurs under your account, whether or not authorized by you. You must notify us promptly of any unauthorized use of your account or any other breach of security. To the maximum extent permitted by applicable law, Aman is not liable for any loss or damage arising from your failure to protect your credentials.
9.3 One account; accurate identity. You agree not to create more than one account except as expressly permitted, not to impersonate any person or entity, and not to misrepresent your identity, role, affiliation, or eligibility.
9.4 Acceptable use. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use complies with all laws, rules, and regulations applicable to you.
9.5 Suspension and termination. To the maximum extent permitted by applicable law, Aman may suspend, restrict, deactivate, or terminate your account or access to the Platform, in whole or in part, at any time, with or without notice or cause, including for any actual or suspected violation of these Terms. You may stop using the Platform and request closure of your account at any time. Provisions that by their nature should survive termination (including Sections 4, 5, 6, 7, 8, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 24) shall survive.
10.1 Independent contractor status. Each Therapist acknowledges and agrees that they are an independent practitioner and not an employee, agent, partner, joint venturer, or representative of Aman. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between any Therapist and Aman. No Therapist has authority to bind or make representations on behalf of Aman.
10.2 Licensing and compliance. Each Therapist is solely responsible for (a) holding and maintaining all licences, registrations, certifications, qualifications, and insurance required to lawfully provide Therapy Services in every jurisdiction in which they practice or in which their Patients are located; (b) complying with all applicable laws, professional standards, codes of conduct, ethical rules, and regulatory requirements; and (c) determining whether they may lawfully provide services to any particular Patient.
10.3 Taxes. Each Therapist is solely responsible for determining, reporting, collecting, remitting, and paying all taxes, levies, and contributions arising from their provision of Therapy Services and any amounts they receive through or in connection with the Platform.
10.4 Accuracy of submitted information. Each Therapist represents and warrants that all information, certificates, credentials, and Content they submit are true, accurate, current, complete, and not misleading, and that they have the right to submit them. Therapists must promptly update any information that becomes inaccurate or out of date, including the lapse, suspension, or revocation of any licence or credential.
10.5 Responsibility for services. Each Therapist is solely responsible for the Therapy Services they provide, including obtaining informed consent, maintaining appropriate records, safeguarding patient information in accordance with applicable law, carrying appropriate professional indemnity insurance, and managing the clinical relationship with their Patients. Aman does not supervise or assume responsibility for any of the foregoing.
10.6 Therapist indemnity. In addition to Section 15, each Therapist agrees to indemnify and hold Aman harmless from any claim arising out of or relating to the Therapy Services they provide, their professional conduct, their compliance or non-compliance with applicable law, or the accuracy of the information and Content they submit.
10.7 Professional-conduct feedback. Aman may appoint one or more qualified practitioners (each an "Advisor") to assist Aman in overseeing professional and ethical conduct on the Platform. Aman or its Advisor may, but is not obliged to, request, collect, and review feedback from Patients about a Therapist's professional and ethical conduct. Aman may consider such feedback, together with any other information available to it, when deciding whether to take action under these Terms, including a warning, suspension, or removal. Providing feedback is optional for Patients. This review is not clinical supervision of Therapy Services and does not make Aman or any Advisor responsible for those services (see Section 10.5).
11.1 Fees. Aman may charge fees for access to certain features, listings, premium or membership tiers, or for facilitating bookings or payments. Applicable fees, charges, and billing terms will be presented to you before you incur them. Unless stated otherwise, fees are exclusive of taxes, which you are responsible for where applicable.
11.2 Payment processing. Payments may be processed through third-party payment processors. Your use of such processors may be subject to their separate terms and privacy policies, and you authorize Aman and/or its processors to charge your selected payment method for amounts due. Aman is not responsible for the acts or omissions of third-party payment processors, to the maximum extent permitted by applicable law.
11.3 Charges for Therapy Services. Where a Therapist sets the price for their Therapy Services, that price is determined by the Therapist. The economic relationship for the Therapy Services themselves is between the Patient and the Therapist, except to the extent Aman expressly acts as a limited payment-collection agent or facilitator.
11.4 Cancellations, credits, and refunds. Most cancellations on the Platform are resolved with Aman Credit — an in-app credit balance, denominated in the currency you paid in, that never expires and can be applied toward any future booking on the Platform — rather than a refund to your original payment method. The specific rule that applies depends on the booking's status at the time of cancellation, as follows (the exact windows and thresholds are shown in the Platform at the time of booking and cancellation, and the version shown in-app at the relevant time controls):
(a) Confirmed bookings. If you cancel a confirmed, paid booking more than the credit window shown in the app (currently 48 hours) before its scheduled start, you receive the full amount you paid as Aman Credit. If you cancel within that window, no credit is issued for that booking.
(b) Unconfirmed, declined, or expired requests. If a booking request is cancelled by you or the Therapist, declined by the Therapist, or expires before the Therapist confirms it, the full amount is returned to you as Aman Credit, applied instantly.
(c) Instant ("talk now") sessions. If an instant session cannot go ahead — for example, no Therapist becomes available — the full amount paid is credited to your Aman Credit balance straight away, and may be refunded under paragraph (e).
(d) Therapist cancellations and no-shows. If a Therapist cancels a confirmed booking, or does not join a session as scheduled, the full amount is returned to you as Aman Credit, applied instantly, assessed on the facts of that booking in accordance with the Platform's policies.
(e) Aman Credit is personal to your account, non-transferable, and never expires. Only the portion of your Aman Credit that you actually paid for, and have not already used, is eligible for a refund; credit Aman adds to your account is spent first and is not itself refundable, unless Aman marks it refundable when it is added. Eligible credit may be refunded on request from the Aman Credit screen's Request a refund button, which refunds the whole refundable balance in that currency in one request. A refund follows your original payment method: a card payment is refunded to that card, while a Raast payment, a card payment made more than around 90 days earlier, or credit with no traceable original payment requires your bank account details and is paid out manually by Aman. A refund request is reviewed by Aman and, once approved, is initiated straight away and usually reaches you within 5–7 working days. Credit cannot otherwise be exchanged for cash.
(f) If you believe a cancellation, credit, or refund was handled incorrectly, you may raise it through the in-app report mechanism described in Section 12.4; any such dispute is decided in accordance with Section 11.5.
Except as set out above, as required by applicable law, or as expressly stated at the point of purchase, fees paid to Aman are generally non-refundable. Eligibility for any credit or refund is determined in accordance with Section 11.5.
11.5 Disputes; Aman's final decision. In the event of any dispute, chargeback, or disagreement relating to a payment, fee, charge, booking, cancellation, no-show, or refund arising through or in connection with the Platform, Aman (as the platform owner) shall have the final say. To the maximum extent permitted by applicable law, Aman's determination of any such payment, billing, or refund dispute shall be final and binding on the parties. Nothing in this Section limits any non-waivable right you may have under mandatory consumer-protection or other applicable law, including any right to pursue a chargeback with your card issuer, to dispute a charge before a competent authority, or to any statutory refund or remedy that cannot lawfully be excluded.
11.6 Failed or reversed payments. You are responsible for any costs Aman incurs as a result of failed, reversed, or disputed payments attributable to you, to the maximum extent permitted by applicable law.
11.7 Therapist payouts. Aman pays each Therapist the amounts due to them for Therapy Services booked through the Platform, net of applicable fees, commissions, cancellation penalties, refunds, and credits, to the payout method on their account. Aman will process a valid payout request within seven (7) business days of receiving it. This period may be extended where Aman needs to verify the request or the payout details, where a related dispute, refund, or chargeback is pending, or where a delay is caused by a bank or payment processor.
12.1 Bookings, appointments, cancellations, rescheduling, and no-shows may be subject to the policies presented within the Platform and/or set by individual Therapists. You are responsible for reviewing and complying with the applicable cancellation and rescheduling terms before booking.
12.2 Cancellation fees, no-show fees, or forfeiture of prepaid amounts (if any) are governed by the applicable policy in effect at the time of booking and by Section 11. Any dispute regarding such fees is subject to Aman's final-decision authority under Section 11.5, to the maximum extent permitted by applicable law.
12.3 Aman does not guarantee the availability, punctuality, or attendance of any Therapist or Patient for any booking, and is not responsible for missed, delayed, cancelled, or rescheduled appointments, to the maximum extent permitted by applicable law.
12.4 Session reports and disputes. The Platform may provide an in-app mechanism for a Patient or a Therapist to report a problem with a session (for example, that the other party failed to join). Such reports are subject to the eligibility rules, time limits, and other requirements presented in the Platform at the time of filing (which may include a limited filing window after the scheduled session and a limit of one report per session). Aman may, but is not obliged to, investigate any report, may request additional information, and may consider any relevant information available to it — including the session metadata and attendance records described in Section 15.4 — in reaching a decision. Decisions on reports and any related refunds are made in accordance with Section 11.5.
12.5 Evidence integrity. If you submit screenshots, images, or any other material in support of a report or dispute, you represent and warrant that such material is genuine, unaltered, and not misleading. Submitting false, fabricated, manipulated, or misleading reports or evidence is a material breach of these Terms and may result in rejection or reversal of any refund or other remedy obtained, recovery of any amounts paid out in reliance on such material, and suspension or termination of your account, in addition to any other remedy available at law, to the maximum extent permitted by applicable law.
12.6 Automated remedies. Certain remedies may be applied automatically by the Platform in accordance with the policies presented in-app (for example, an automatic cancellation with the amount credited to Aman Credit where a Therapist does not join an on-demand session within the time stated in the Platform). Any such automated remedy is limited to the amount actually paid for the affected session and does not create any entitlement to further compensation, to the maximum extent permitted by applicable law.
13.1 Aman's rights. The Platform and all software, designs, text, graphics, logos, trademarks, service marks, trade names, user interfaces, and other materials provided by Aman (excluding User Content) are owned by or licensed to Aman and are protected by intellectual-property and other laws. Except for the limited licence granted below, no rights are granted to you.
13.2 Limited licence to you. Subject to your compliance with these Terms, Aman grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for its intended purposes. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of any part of the Platform except as permitted by applicable law that cannot be contractually waived.
13.3 User Content licence. You retain ownership of Content you submit. By submitting Content, you grant Aman a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, display, adapt, and use such Content as reasonably necessary to operate, provide, improve, secure, and promote the Platform, to the extent permitted by applicable law and our Privacy Policy. You represent and warrant that you have all rights necessary to grant this licence and that your Content does not infringe any third-party rights or violate any law.
13.4 Feedback. If you provide suggestions or feedback about the Platform, you grant Aman an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose without obligation to you.
13.5 Infringement notices. If you believe Content on the Platform infringes your intellectual-property rights, please contact us at support@myamanapp.com with sufficient detail to allow us to investigate. Aman may remove allegedly infringing Content and/or terminate repeat infringers, to the maximum extent permitted by applicable law.
14.1 You agree that you will not, and will not permit or assist any third party to:
(a) use the Platform for any unlawful, fraudulent, harmful, or unauthorized purpose, or in violation of any applicable law or regulation;
(b) provide false, inaccurate, or misleading information, or misrepresent your identity, role, credentials, or affiliation;
(c) use the Platform to provide or solicit services you are not legally permitted to provide or receive;
(d) harass, abuse, threaten, defame, stalk, or harm any other user, Therapist, or person;
(e) upload or transmit any Content that is unlawful, defamatory, obscene, infringing, harmful, deceptive, or that contains malware, viruses, or other harmful code;
(f) circumvent, disable, or interfere with the security, integrity, or proper functioning of the Platform, or attempt to gain unauthorized access to any systems, accounts, or data;
(g) scrape, harvest, data-mine, crawl, or otherwise collect information or Content from the Platform without authorization, or use bots or automated means except as expressly permitted;
(h) use the Platform to circumvent applicable fees, including by soliciting or arranging off-Platform transactions in order to avoid Aman's fees where prohibited by the applicable policy;
(i) interfere with, disrupt, or impose an unreasonable load on the Platform or its infrastructure;
(j) reproduce, duplicate, copy, sell, resell, or exploit any part of the Platform without our express written permission;
(k) use the Platform in any manner that could damage, disable, overburden, or impair Aman or interfere with any other party's use of the Platform;
(l) record, photograph, capture, store, or distribute the audio, video, or content of any session, or of any communication with another user, without the express consent of all participants, except as permitted by applicable law; or
(m) submit any false, fabricated, manipulated, or misleading report, dispute, or supporting evidence (including altered screenshots or images), as further described in Section 12.5.
14.2 Violation of this Section may result in suspension or termination of your account and may expose you to civil and/or criminal liability. Aman reserves the right, to the maximum extent permitted by applicable law, to investigate and take appropriate action, including reporting to law-enforcement authorities.
15.1 Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference and which describes how we collect, use, disclose, and safeguard personal information. Please review the Privacy Policy at www.myamanapp.com/privacy.
15.2 By using the Platform, you consent to the data practices described in the Privacy Policy, to the extent permitted by applicable law. Where applicable law requires specific consents (for example, for the processing of health-related or other sensitive data), such processing is carried out in accordance with those requirements.
15.3 Therapists are independently responsible for their own handling of Patient information in connection with Therapy Services, including compliance with applicable health-privacy, data-protection, and confidentiality laws, and are not relieved of those responsibilities by Aman's Privacy Policy.
15.4 Session metadata and attendance records. You acknowledge and agree that, for the purposes of dispute resolution, fraud prevention, safety, support, and the integrity of the Platform, Aman collects and processes technical metadata about sessions arranged through the Platform. This may include booking, cancellation, and rescheduling events; in-app presence signals (such as when a participant taps "Join" or remains on a session waiting screen); and attendance and telemetry records provided by the third-party video-conferencing service through which sessions are conducted, which may include participant display names, join and leave times, call duration, device type, IP address, and approximate location. Aman does not record, store, or listen to the audio or video content of any session. Session metadata and attendance records are handled in accordance with our Privacy Policy and may be relied upon by Aman in resolving reports and disputes under Sections 11 and 12.
15.5 Third-party conferencing services. Sessions are conducted through third-party video-conferencing services (currently Daily.co). Your use of such services is subject to the applicable third party's own terms and privacy policy, and Aman is not responsible for the availability, performance, security, or data practices of such third-party services, to the maximum extent permitted by applicable law.
15.6 Not a medical-records system; data minimisation. Aman is a booking and matching platform and does not require, request, or store clinical, diagnostic, or treatment records. Free-text fields — such as a Patient's "what I'd like to talk about" message and a Therapist's brief session reminders — are kept short and are not intended for clinical content. The Patient's booking message is deleted shortly after the session, and when you delete your account your session-related content is permanently deleted, as described in our Privacy Policy.
16.1 "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, the Platform and all Content, features, and services are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind. Aman operates globally and makes no representation that the Platform is appropriate, lawful, or available for use in any particular location.
16.2 Disclaimer. To the maximum extent permitted by applicable law, Aman, its affiliates, and its licensors disclaim all warranties, conditions, and representations of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, quiet enjoyment, and non-infringement, and any warranties arising from course of dealing or usage of trade.
16.3 No warranty as to users or outcomes. Without limiting the foregoing, Aman does not warrant that: (a) any Therapist is qualified, licensed, competent, safe, or suitable; (b) any Therapy Services will be effective, safe, or of any particular quality or outcome; (c) the Platform will be uninterrupted, secure, timely, or error-free; (d) any defects will be corrected; or (e) the Platform or its servers are free of harmful components. Any reliance on the Platform or on any Therapist is at your own risk.
16.4 Jurisdictional limits. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain statutory rights. Accordingly, some or all of the above exclusions and limitations may not apply to you, and you may have additional rights. In such jurisdictions, Aman's warranties and liability are limited to the minimum extent, and for the shortest duration, permitted by applicable law.
17.1 You understand and agree that engaging a Therapist and receiving Therapy Services involves inherent risks, and that the choice of Therapist and the decision to act on any Therapy Services are made by you, the Patient, at your own discretion and risk.
17.2 To the maximum extent permitted by applicable law, you voluntarily assume all risks associated with (a) your selection of, and interactions with, any Therapist; (b) the Therapy Services you receive; (c) any in-person or remote communications or meetings; and (d) any reliance on information obtained through the Platform. You are responsible for taking reasonable precautions in all interactions with other users, particularly when meeting or communicating with any person.
17.3 Aman does not conduct in-person supervision of, and is not present during, any interaction between a Patient and a Therapist, and is not responsible for the conduct of any user, to the maximum extent permitted by applicable law.
18.1 Exclusion of indirect damages. To the maximum extent permitted by applicable law, in no event shall Aman or its affiliates, officers, directors, employees, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to these Terms or your use of (or inability to use) the Platform, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Aman has been advised of the possibility of such damages.
18.2 Damages relating to Therapists and Therapy Services. To the maximum extent permitted by applicable law, Aman shall not be liable for any damages arising out of or relating to the acts, omissions, advice, conduct, competence, or outcomes of any Therapist, any Therapy Services, any interactions between users, or any content provided by users.
18.3 Cap on liability. To the maximum extent permitted by applicable law, the total aggregate liability of Aman and its affiliates for all claims arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount of fees you actually paid to Aman in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.
18.4 Jurisdictional limits. Some jurisdictions do not allow the exclusion or limitation of certain damages (including, in some cases, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation). Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, and in such jurisdictions Aman's liability is limited to the minimum extent permitted by applicable law.
18.5 Basis of the bargain. The disclaimers and limitations in Sections 16 and 18 are an essential basis of the bargain between you and Aman and reflect a reasonable allocation of risk, given that Aman is a technology platform and not a provider of Therapy Services.
19.1 To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Aman and its affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Platform; (b) your violation of these Terms or any applicable law; (c) your Content or any information you submit; (d) your interactions with, or Therapy Services provided to or by, any other user; (e) in the case of a Therapist, the Therapy Services you provide and your professional conduct and compliance; and (f) your violation of any third-party right, including intellectual-property, privacy, or publicity rights.
19.2 Aman reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Aman's defense. You may not settle any matter affecting Aman without Aman's prior written consent.
20.1 The Platform is operated and offered globally. By accessing the Platform from any location, you do so on your own initiative and are responsible for compliance with all laws applicable in your jurisdiction, including those governing eligibility to receive or provide Therapy Services, telehealth, professional licensing, consumer protection, taxation, data protection, and export controls.
20.2 Aman makes no representation that the Platform, or any Therapist or service available through it, is appropriate, lawful, or available for use in every location. Access to the Platform from territories where its content or use is illegal is prohibited.
20.3 To the maximum extent permitted by applicable law, Aman disclaims warranties and liability in all jurisdictions in which it operates, subject always to mandatory local laws (including consumer-protection laws) that cannot be waived or excluded, which continue to apply to you.
21.1 These Terms are published, and may be updated from time to time, on the Aman website at www.myamanapp.com and may also be made available within the Aman mobile application.
21.2 The Aman website and the Aman mobile application are part of a single, unified Platform and are governed by these same Terms. References in these Terms to the "Platform" or "Service" apply equally to the website and the app, except where a provision expressly states otherwise.
21.3 In the event of any inconsistency between versions of these Terms displayed in different channels, the version most recently published by Aman (as indicated by its Effective date and version number) shall be treated as the controlling version, except to the extent applicable law requires otherwise.
22.1 Governing law. These Terms and any dispute or claim arising out of or relating to them, the Platform, or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with applicable law, except to the extent that mandatory laws of your country of residence require otherwise.
22.2 Informal resolution. Before commencing any formal proceeding, you agree to first contact us at support@myamanapp.com and attempt in good faith to resolve the dispute informally for a period of at least thirty (30) days.
22.3 Arbitration (where permitted by law). To the maximum extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that is not resolved informally shall be finally resolved by binding arbitration conducted in accordance with applicable arbitration rules. Judgment on the award may be entered in any court of competent jurisdiction. This arbitration agreement does not prevent either party from seeking interim or injunctive relief from a court where available.
22.4 Class-action waiver (where permitted by law). To the maximum extent permitted by applicable law, you and Aman agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
22.5 Mandatory-law carve-out. Nothing in this Section deprives you of the protection of any mandatory provision of the law of your country of residence, including any non-waivable right to bring proceedings in your local courts, to benefit from local consumer-protection laws, or to decline mandatory arbitration where such arbitration or a class-action waiver is not enforceable under applicable law. Where any part of this Section is unenforceable under applicable law as to a particular dispute or user, that part shall not apply to that dispute or user, and the dispute shall instead be resolved by a court of competent jurisdiction or, where required, your local courts.
23.1 Aman may modify, update, or replace these Terms at any time, to the maximum extent permitted by applicable law. When we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms on the website with a revised "Effective date", and/or by providing notice within the Platform.
23.2 Changes are effective when posted, unless otherwise stated or unless applicable law requires advance notice or consent. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
23.3 It is your responsibility to review these Terms periodically. The current version is always available at www.myamanapp.com.
24.1 Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable or, if it cannot be so modified, severed, and the remaining provisions shall remain in full force and effect.
24.2 Entire agreement. These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Aman regarding the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and communications, whether written or oral, on that subject. Any additional or different terms in your communications are rejected unless expressly agreed by Aman in writing.
24.3 No waiver. No failure or delay by Aman in exercising any right under these Terms shall constitute a waiver of that right, and no single or partial exercise of any right shall preclude any further exercise.
24.4 Assignment. You may not assign or transfer these Terms or any rights or obligations under them without Aman's prior written consent. Aman may freely assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets.
24.5 Force majeure. To the maximum extent permitted by applicable law, Aman shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, governmental action, labor disputes, internet or telecommunications failures, or third-party service outages.
24.6 Relationship of the parties. Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, or employment relationship between you and Aman.
24.7 Notices. Aman may provide notices to you via the Platform, by email to the address associated with your account, or by posting on the website. You may contact Aman as set out in Section 25.
24.8 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
24.9 Language. These Terms may be made available in multiple languages. Where permitted by applicable law, the English version shall control in the event of any conflict.
